These Terms & Conditions apply to cycling coaching services provided by Cassiopeia Performance, operated by Natalie Kaebisch.

By engaging Cassiopeia Performance for coaching services, you agree to these Terms & Conditions.

1. Coaching Services

Cassiopeia Performance provides personalised cycling coaching designed to support athletes in developing their performance, fitness and enjoyment of cycling.

Coaching may include:

  • individualised training programs

  • training planning and periodisation

  • review and analysis of training data

  • feedback on completed training

  • communication regarding training, goals and progress

  • adjustments to training based on training response, availability, goals and circumstances

  • guidance relating to preparation for training and cycling events.

Coaching is personalised to each athlete and may vary depending on the coaching package selected.

2. Getting Started

Before coaching commences, you will be asked to provide information about your cycling and training history, goals, available training time and other factors relevant to planning your program.

An initial conversation may also be arranged to discuss your goals and expectations.

Your TrainingPeaks account will then be connected to Cassiopeia Performance so that your training plan and relevant training information can be managed through the platform.

Your first training program will generally be uploaded within one week of receiving the information required to commence coaching. The timing may vary depending on when you contact Cassiopeia Performance and where you are in your training cycle.

3. TrainingPeaks

Training plans are delivered through TrainingPeaks.

You are responsible for having an active TrainingPeaks account and for ensuring that your training data is uploaded accurately and regularly.

TrainingPeaks is a third-party platform and is subject to its own terms and privacy policy.

Cassiopeia Performance is not responsible for interruptions, technical issues or changes to TrainingPeaks that are outside its control.

4. Coaching Communication

Communication is an important part of the coaching relationship.

Athletes can contact Cassiopeia Performance regarding their training, progress, goals or circumstances that may require adjustments to their program.

Cassiopeia Performance aims to respond to messages within two working days.

Response times may occasionally be longer during periods of leave, illness or circumstances outside reasonable control. Where possible, athletes will be advised of extended periods of unavailability.

5. Training Adjustments

Training is intended to be flexible and responsive to the athlete's circumstances.

Athletes are encouraged to communicate changes in workload, availability, fatigue, illness, injury, travel, family commitments or other factors that may affect their ability to complete planned training.

Cassiopeia Performance may adjust training in response to this information.

Athletes remain responsible for communicating relevant changes so that appropriate adjustments can be considered.

6. Coaching Packages

All coaching packages operate on a month-to-month basis.

The level of service, communication and support provided will depend on the coaching package selected.

Athletes may request to change their coaching package by providing at least two weeks' notice.

There is no start-up fee.

7. Fees and Payment

Coaching fees are charged according to the package selected at the time of engagement.

Invoices will be issued by Cassiopeia Performance and payment is due by the date specified on the invoice.

Where an invoice remains unpaid, Cassiopeia Performance may suspend coaching services until payment is received.

Cassiopeia Performance reserves the right to update coaching fees. Where a change to your ongoing coaching fee is proposed, reasonable notice will be provided before the new fee takes effect.

8. Cancelling or Ending Coaching

You may end your coaching arrangement by providing two weeks' notice.

You may also request to change to another coaching package with two weeks' notice.

Any outstanding fees for services already provided or falling within the applicable notice period remain payable.

Cassiopeia Performance may end a coaching arrangement where there is a persistent failure to pay fees, inappropriate or abusive communication, or another significant breach of these Terms & Conditions. Where appropriate, reasonable notice will be provided.

9. Cancellation by Cassiopeia Performance

Cassiopeia Performance reserves the right to decline or discontinue coaching services where it considers this necessary or appropriate, including where there is a breakdown in the coach-athlete relationship, non-payment of fees, inappropriate or disrespectful behaviour, or where the athlete's needs fall outside the scope of the services provided.

Where reasonably practicable, Cassiopeia Performance will provide notice of the decision and any applicable outstanding fees will remain payable.

10. Athlete Responsibilities

To get the most from coaching, athletes are expected to:

  • provide accurate and relevant information about their training, goals and circumstances

  • complete training to the best of their ability

  • communicate significant changes that may affect training

  • regularly upload relevant training data to TrainingPeaks

  • communicate when planned training cannot be completed

  • raise concerns or questions about their training promptly

  • maintain appropriate equipment and ensure their bicycle and other equipment are safe and suitable for use

  • follow relevant event, road and cycling safety requirements

11. Health, Injury and Exercise

Cycling and physical training involve inherent risks, including the possibility of injury, illness or accident.

Coaching advice is based on the information available to Cassiopeia Performance at the time.

Athletes are responsible for monitoring how they feel during training and should stop or modify exercise if they experience concerning symptoms or believe continuing may be unsafe.

Where appropriate, athletes should seek advice from a suitably qualified medical or health professional regarding health concerns, injury or their ability to participate in physical activity.

Cassiopeia Performance does not provide emergency medical care.

12. Individual Results

Coaching is designed to support athletes in progressing towards their individual goals. However, training outcomes cannot be guaranteed.

Performance is influenced by many factors, including training consistency, recovery, health, lifestyle, nutrition, genetics, environmental conditions and circumstances outside the control of Cassiopeia Performance.

No specific performance result, race result, qualification, selection or other outcome is guaranteed.

13. Intellectual Property

Training programs, written coaching materials, resources and other materials created by Cassiopeia Performance for an athlete are provided for that athlete's personal use.

They must not be copied, reproduced, distributed, published, sold or provided to another person without prior written permission from Cassiopeia Performance.

14. Privacy

Personal information provided to Cassiopeia Performance will be handled in accordance with the Cassiopeia Performance Privacy Policy.

The Privacy Policy explains how personal information is collected, used, stored and disclosed.

15. Limitation of Liability

To the extent permitted by law, Cassiopeia Performance will not be liable for loss, damage, injury or expense arising from participation in cycling or training activities where that loss, damage, injury or expense results from circumstances outside Cassiopeia Performance's reasonable control.

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded under Australian consumer law or other applicable legislation.

Where liability cannot legally be excluded, it is limited to the extent permitted by law.

16. Force Majeure

Cassiopeia Performance will not be responsible for delays or failure to provide services where this results from circumstances beyond reasonable control, including serious illness, natural disasters, significant technology failures, government restrictions or other unforeseen events.

Where practical, reasonable efforts will be made to communicate with affected athletes and resume services as soon as possible.

17. Changes to These Terms

Cassiopeia Performance may update these Terms & Conditions from time to time to reflect changes to services, pricing, business practices or legal requirements.

Where a change materially affects an existing coaching arrangement, reasonable notice will be provided.

The current version will be available on the Cassiopeia Performance website.

18. Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia.

Any dispute arising in connection with these Terms & Conditions will be subject to the applicable laws and courts of New South Wales, subject to any rights you may have under Australian consumer law.
